WPCA Minutes - Regular Meeting 1/2/07
A.      ROLL CALL

Members Present:        Joseph Carino, Robert Dickinson, Frank Ferrero, Carol Fletterick, and Ed Havens, Jr., R. Max Scheller

        Members Absent: Richard Aries

        Alternates Present:     Thomas Deming sitting for Richard Aries

        Alternates Absent:      Susan Rose

        Staff Present:  C. Fred Shaw, Superintendent of Pollution Control

Chairman Carino called the meeting to order at 7:30 p.m.  The following actions were taken during the January 2, 2007 Regular Meeting of the W.P.C.A.

B.      ACCEPTANCE OF MINUTES OF PREVIOUS MEETINGS

The minutes were modified as follows:

On page 1, Item G – UNFINISHED BUSINESS, 2nd paragraph, 3rd sentence remove the word “the”.  The sentence should read as follows: “Mr. Ferrero stated that he believes that the Authority should make every effort to notify as many people as they can about the public hearing”

On page 2 Item C – NEW BUSINESS, change the phrase “regular meeting” to “public hearing”.  The sentence should read as follows “Chairman Carino suggested having the public hearing on the 1st Tuesday of February prior to the regular meeting.”

Motion was made to accept the minutes of the December 5, 2006 regular meeting with the corrections being made.

C.      NEW BUSINESS

1.      230 Deming Street (Approval to remove from Utility Billing List)

Mr. Shaw reported that this property was demolished back in November 2005.  Therefore, he recommended removing this property from the Utility Billing List.  Prorated user charges would be billed for FY 2005/2006.

Motion to remove 230 Deming Street from the Utility Billing List, because this property was demolished in November 2005.  The prorated user charges will be billed for FY 2005/2006.

2.      1562 Main Street (Unbilled User Charges – Multi-family Residence)

The house at this address is a multi-family residence, and has been so for a number of years.  The Town was not aware that this property was converted to a multi-family home until recently.  A lien was never placed on the property for unbilled user charges.  The Town billed for multi-family use.  However, the Attorney for the property owner has expressed that the Town would not go back fifteen years to bill for services (see Exhibit A.)  There was a consensus to refer this matter to the Town Attorney for legal opinion.

G.      UNFINISHED BUSINESS

1.      Review Town Attorney Comments – Proposed FOG Regulations

A detailed discussion ensued regarding the proposed draft of FOG Regulations.  Mr. Shaw reviewed with the Town Attorney the proposed draft of the Fog Regulations recommended by the Authority (attached see Exhibit B and C).  Also, attached please find changes recommended by the Town Attorney (see Exhibit D and E).

The proposed draft was discussed at this meeting and a lengthy discussion ensued on Section 6.5.c.2.i which reads as follows: “a change in ownership of the facility shall require compliance with all conditions of this regulation within 60 days of the change in ownership”.  Chairman Carino stated that 60 days is not a fair time to be given to the new owner(s), when in fact all other FOG generators have until July 1, 2011 to comply with all conditions of the regulation.  After discussion, the Authority was in full agreement with Chairman Carino; and therefore, the following changes by the Authority were recommended to the regulations in Section 6.5.c.2.  The compliance date was changed from July 1, 2001 to July 1, 2009; and Section 6.5.c.2.i was removed.

Motion to modify the FOG Regulations as follows: In Section 6.5.c.2., change date from July 1, 2011 to July 1, 2009; also, remove Section 6.5.c.2.i. regulation.

2.      Set Date for FOG Regulations Public Hearing

Mr. Shaw feels that the FOG regulations are finalized enough to schedule the FOG Regulations Public Hearing.

Motion to schedule the WPCA – FOG Regulations Public Hearing for Tuesday, February 6, 2007 at 7:00 p.m.

The motion carried unanimously

H.      MOTION TO GO INTO EXECUTIVE SESSION TO DISCUSS PENDING CLAIMS
None

I.      ADJOURNMENT

Motion was made to adjourn the meeting at 8:51 p.m.
